If you are pulled over by law enforcement in Wisconsin on suspicion of OWI, they may ask you to provide a blood sample to determine your BAC level. Under Wisconsin's Implied Consent law, anyone who drives on public roads in the state automatically consents to a breath, blood, or urine test if stopped for OWI. During an OWI investigation, Wisconsin law enforcement can conduct two breath tests: a roadside test and an evidentiary test.
While the roadside test is optional, refusing the evidentiary breath test at the police station violates the Implied Consent law. If you refuse the test, your license will be automatically revoked. To protect your rights and driving privileges, it is crucial to contact me immediately to request a hearing within 10 days.
